The Schultzes hired the Olshan Foundation Repair Company of Mobile ("Olshan") to perform foundation work on their house three different times. When the work was not performed to the Schultzes liking, they sued and Olshan sought to compel arbitration. The Supreme Court of Alabama held that the Schultzes did not present enough evidence to show that the 2009 work was not performed pursuant to the 2007 contract; it therefore granted the motion to compel arbitration.
