In the first few years after the Chinese Communist Party took power over China in 1949, there was no functional legal system because of the Party's "long established hostility to law" under Chinese Confucian tradition, and because of the Marxist theory, which regarded laws as "a tool of the former ruling classes destined to wither away along with the state."
